I guess you missed the part in my last email where I stated you can feel free to email me directly. All my web host is going to do is pass your emails on, so how about saving them the trouble in the future? As you can see, they have been CCed this email and are well aware of the situation. Let's get started. > VIA EMAIL: > > SECOND Demand for Immediate Take-Down: Notice of Infringing Activity > > URL: http://www.guidoz.com/requests/WGA%20Tray%20Removal%20(GuidoZ).exe > CASE #: 45677 > > 06 July 2006 Again, the above is merely for your own records so we're all on the same page. > Dear Sir or Madam, > > Microsoft has received information that the domain listed above, which appears > to be on servers under your control, is offering unlicensed copies of, or is > engaged in other unauthorized activities relating to copyrighted works > published by Microsoft. We've already been over this. (You can reference my previous email.) > 1. Identification of copyrighted works: > > Copyrighted work(s): > Windows XP Professional > Windows XP Home Edition > > Copyright owner: > Microsoft Corporation Again, no argument from me. We all agree Microsoft hold those copyrights. Moving on... > 2. Copyright infringing material or activity found at the following > location(s): http://www.guidoz.com/requests/WGA%20Tray%20Removal%20(GuidoZ).exe > > The above location is offering 'Cracks' or 'Product Keys', intended to > circumvent technical measures that control access to Microsoft's copyrighted > works and that protect Microsoft's copyrights in those works. Hmm. I thought we also covered this in the last email as well. Once again, the EXE you are referring to is in no way, shape, or form a "Crack". It's an uninstaller, pure and simply. It doesn't contain any "Product Keys" either. In fact, it's no different then this one, hosted by a well known freeware hoster: http://www.softpedia.com/get/Tweak/Uninstallers/RemoveWGA.shtml I'd like you to also take note of the category it's in. UNINSTALLERS. > 3. Statement of authority: > > The information in this notice is accurate, and I hereby certify under penalty > of perjury that I am authorized to act on behalf of Microsoft, the owner of > the copyright(s) in the work(s) identified above. I have a good faith belief > that none of the materials or activities listed above have been authorized by > Microsoft, its agents, or the law. No, it isn't accurate, hence why my web host simply forwards this to me to deal with. You have NO merit and NO right to harass my web host, or me. If this continues I may be forced to take the appropriate legal actions. Harassment is a much more serious offense then hosting an uninstaller on a website. > We hereby give notice of these activities to you and request that you take > expeditious action to remove or disable access to the material described > above, and thereby prevent the unauthorized distribution of these cracks or > product keys via your company's network. Again, I hereby give YOU notice - neither I, nor my web host, will do nothing of the sort. No copyright laws are being broken. No cracks are being freely distributed. Your claims are unfounded and have no merit. > We appreciate your cooperation in this matter. Please advise us regarding > what actions you take. I'd also appreciate your cooperation in stopping the madness! As for the actions that have been taken, again just try to download the file in question quoted above.
